Voice Language Translator Privacy Policy

1. Introduction

This Privacy Policy explains how AVIRISE LIMITED (CY), referred to in this Policy as “we”, “us” or “our”, collects, uses, shares and protects Personal Data when you use the Voice Language Translator application for iPhone and iPad, referred to in this Policy as the “Service”. The Service is distributed exclusively through the Apple App Store. In this Policy, “Personal Data” means any information relating to an identified or identifiable natural person. “Online Mode” and “Offline Mode” have the meanings given in Section 5.

2. Who We Are

3. Key Points

  • In Offline Mode, your voice, transcriptions and translations never leave your device.
  • In Online Mode, your voice, transcriptions and translations are sent to the AI providers described in Section 8.1, and only after you give explicit permission in the Service.
  • The Service never switches from Offline Mode to Online Mode on its own.
  • We do not store your voice recordings on our servers. We do not use your content to train AI models, and our AI providers are contractually prohibited from doing so.
  • Your voice, transcriptions and translations are never shared with analytics or advertising partners, including Meta.
  • Your translation history is stored on your device and is not uploaded to our servers.
  • Advertising measurement and non-essential analytics run only with your permission.

4. Information We Collect

4.1 Microphone and Audio Data

The Service accesses your microphone only after you grant permission through iOS, and only while you actively use a voice feature, for example by tapping the microphone button or starting a conversation session. The Service does not listen in the background and does not use wake words. Audio capture stops when you end the session or leave the voice feature. iOS displays a recording indicator whenever the microphone is in use. If you deny or revoke microphone access, text translation remains available and voice features are disabled. You can change this permission at any time in iOS Settings, Privacy and Security, Microphone.

4.2 Transcriptions, Translations and Text Input

We process the text produced from your speech, any text you type or paste for translation, the resulting translations and the languages you select, solely to provide translation.

4.3 Translation History

If you save translations or keep history enabled, saved items are stored on your device only. Section 11 explains how this data is stored and how to delete it.

4.4 Device and Usage Data

We collect the following device and usage data:

  • device model;
  • iOS version;
  • app version;
  • device language;
  • country or region derived from your IP address;
  • IP address;
  • an app-specific installation identifier;
  • crash reports and performance diagnostics; and
  • events describing which features are used and when, which never include the content of your speech, text or translations.

Only if you permit tracking under Section 9.5, we also access your device advertising identifier.

4.5 Purchase and Subscription Data

All payments are processed by Apple. We never receive your payment card details, your name or your Apple Account email address. Apple provides us with the following information:

  • the product purchased;
  • its price and currency;
  • transaction identifiers;
  • purchase, trial, renewal and cancellation dates;
  • subscription status; and
  • your App Store country.

4.6 Support Communications

If you contact us, we process your email address, the content of your message and any information you choose to include.

4.7 What We Do Not Collect

We do not ask you to create an account. We do not collect your name or contact details unless you contact us. We do not create voiceprints or any other biometric identifier, and we do not identify people by their voice.

5. Online and Offline Modes

5.1 Online Mode

Before any audio or text is sent to a third-party AI provider for the first time, the Service displays a notice and asks for your explicit permission. The notice identifies:

  • the data to be sent, namely your voice recording, its transcription, any text you enter and the translated text; and
  • the specific AI providers that will receive it.

Online Mode operates only after you give that permission. While it is active, your audio and text are transmitted over an encrypted connection to these providers and processed in real time to produce the transcription and translation. You can withdraw your permission at any time in the Service under Settings, Privacy, Online Mode. After withdrawal, the Service operates in Offline Mode for the languages available offline, and no further audio or text is sent to AI providers.

5.2 Offline Mode

In Offline Mode, speech recognition, translation and any spoken playback run entirely on your device, using models stored on your device. An internet connection is needed only to download language models, and these downloads contain none of your audio or text. Device and usage data described in Section 4.4, which never includes content, may be recorded while you are offline and sent when your device reconnects, subject to your choices under Section 9.

5.3 Mode Selection

The Service never switches from Offline Mode to Online Mode automatically. If Offline Mode is selected, or if you have not given permission for Online Mode, no audio, transcription, text input or translation is transmitted from your device, even while your device is connected to the internet. The active mode is displayed on the translation screen at all times.

6. Artificial Intelligence Transparency

6.1 The Service as an AI System

The Service is an artificial intelligence system within the meaning of Regulation (EU) 2024/1689 on artificial intelligence, and AVIRISE LIMITED (CY) is its provider. In both Online Mode and Offline Mode, speech recognition, translation and any spoken playback of translations are generated automatically by machine learning models, not by human translators. In Online Mode these models are operated by third-party AI providers. In Offline Mode they run exclusively on your device.

6.2 Intended Purpose

The Service is intended solely to help individuals understand and communicate across languages in everyday personal, travel and general business situations. It is not designed, validated or marketed for use in any area listed as high-risk in Annex III of Regulation (EU) 2024/1689. The Service must not be relied upon as the sole means of communication where an error could affect a person’s health, safety, legal rights or legal obligations, such as medical consultations, legal proceedings or emergencies.

6.3 What the Service Does Not Do

The Service does not:

  • identify or verify individuals by their voice;
  • create or store voiceprints or any other biometric template;
  • perform biometric categorisation; or
  • detect or infer emotions, intentions, health status or other personal characteristics from your voice or from the content you translate.

Audio is processed only to convert speech into text and to translate it.

6.4 Labelling of AI Output

Translations are labelled in the Service as machine-generated. Where the Service produces spoken output, that speech is identified in the Service as computer-generated and, to the extent technically feasible, is marked in a machine-readable format as artificially generated. Machine translation may contain errors, omissions or mistranslations. Verify important content with a qualified human translator.

6.5 No Training on Your Data

We do not use your audio recordings, transcriptions, text input or translations to train, retrain, fine-tune, evaluate or otherwise improve any artificial intelligence model, whether our own or a third party’s. We engage AI providers strictly under data processing terms that prohibit them from:

  • using your content to train, fine-tune or improve any model, including foundation and general-purpose AI models;
  • subjecting your content to human review for product improvement;
  • building profiles about you; and
  • combining your content with any other data.

We do not use any free, trial or consumer tier of an AI service whose terms permit submitted content to be used for model improvement or human review. The only retention permitted to our AI providers is the temporary logging described in Section 10, which they may apply solely to detect abuse of their service or to comply with a legal obligation.

7. How We Use Personal Data and Our Legal Bases

We process your Personal Data for the following purposes and legal bases:

  • Translating speech and text in Offline Mode and keeping translation history: Performance of our contract with you (Article 6.1.b GDPR).
  • Sending content to AI providers in Online Mode: Your explicit consent (Article 6.1.a and 9.2.a GDPR).
  • Providing paid features and managing subscriptions: Performance of our contract with you (Article 6.1.b GDPR).
  • Keeping tax and accounting records: Legal obligation (Article 6.1.c GDPR).
  • Crash diagnostics, security and fraud prevention: Our legitimate interest in providing a stable and secure Service (Article 6.1.f GDPR).
  • Non-essential product analytics and advertising measurement: Your consent (Article 6.1.a GDPR and ePrivacy Directive).
  • Responding to support requests: Performance of our contract or legitimate interests (Articles 6.1.b and 6.1.f GDPR).
  • Complying with law and defending legal claims: Legal obligation or legitimate interests (Articles 6.1.c and 6.1.f GDPR).

8. AI Providers, Service Providers and International Transfers

8.1 AI Providers Used in Online Mode

In Online Mode, your audio, transcriptions, text input and translations are processed by trusted third-party AI providers. Because we continuously update and optimize our translation engines, the specific AI providers currently receiving your data, their processing locations, and links to their privacy policies are dynamically displayed within the Service’s in-app authorization prompts before you activate Online Mode. We will update this in-app notice before any new AI provider begins receiving your data.

8.2 Other Service Providers

We use the following service providers:

  • Amplitude, Inc., product analytics, United States
  • Crashlytics (Google LLC), crash diagnostics, United States
  • Adapty, purchase validation and subscription status, United States
  • Gmail (Google LLC), handling support requests, United States

None of these providers receives the content of your speech, text or translations.

8.3 Processor Obligations

Each provider listed in Sections 8.1 and 8.2 acts as our processor under their respective terms of service and standard data processing terms. These terms require the provider to:

  • process your data only on our documented instructions;
  • keep it confidential;
  • apply appropriate security measures; and
  • engage sub-processors only under equivalent obligations.

Where an AI provider retains temporary abuse-monitoring logs as an independent controller, it does so under its own privacy policy, as disclosed within the Service.

8.4 Apple and Meta

Apple acts as an independent controller when it processes App Store purchases and payments, and when it stores iCloud backups you enable. Apple’s processing is governed by Apple’s own privacy policy. For the collection and transmission of data through the Meta software development kit described in Section 9, we and Meta Platforms Ireland Limited act as joint controllers. Meta is solely responsible for its subsequent processing of that data under its own privacy policy.

8.5 International Transfers

Some providers process data outside the European Economic Area, including in the United States. Where the destination country has not been recognised by the European Commission as providing an adequate level of protection, we rely on one of the following safeguards:

  • the EU-U.S. Data Privacy Framework, for recipients certified under it; or
  • the Standard Contractual Clauses adopted by the European Commission, together with appropriate supplementary measures.

8.6 Other Disclosures

We may disclose Personal Data where required by law or by a binding request of a public authority, or where necessary to establish, exercise or defend legal claims. If AVIRISE LIMITED (CY) is involved in a merger, acquisition or sale of assets, Personal Data may be transferred to the successor.

9. Analytics, Advertising Measurement and Tracking

9.1 Strict Separation of Your Content

The following are never transmitted to, shared with or made accessible to any analytics, advertising, attribution or marketing partner, including Meta Platforms:

  • your audio recordings;
  • your transcriptions and translations;
  • your translation history;
  • your selected language pairs; and
  • any text you enter.

9.2 What Partners Receive

Subject to your choices below, analytics and advertising partners may receive the device and usage data described in Section 4.4. With your consent, advertising partners may also receive the fact that a trial started or a subscription was purchased, including its price and currency.

9.3 Meta and Other Advertising Partners

We use the Meta software development kit, provided by Meta Platforms Ireland Limited and Meta Platforms, Inc., for advertising measurement and attribution. You can opt out of this collection and use for ad targeting in any of the following places:

  • in the Service, under Settings, Privacy, by switching off Advertising Measurement;
  • on your device, by declining the tracking request, or later under iOS Settings, Privacy and Security, Tracking;
  • in your Meta account, under Accounts Center, Ad preferences.

9.4 Consent in the European Economic Area, the United Kingdom and Switzerland

If you are located in the European Economic Area, the United Kingdom or Switzerland, we do not initialise advertising software development kits, or allow them to store or access information on your device, until you consent through our in-app consent screen.

9.5 App Tracking Transparency

We request your permission through Apple’s App Tracking Transparency framework before accessing your advertising identifier. If you decline, we do not access it, and we restrict our partners’ software development kits accordingly.

10. Data Retention

  • Audio recordings: In Online Mode, audio is streamed to the AI provider and processed in memory. We never store audio recordings on our servers. In Offline Mode, audio is processed in memory on your device and discarded immediately.
  • Transcriptions, text input and translations: We do not store these on our servers. Our AI providers may keep a temporary copy for a strictly limited temporary period solely to detect abuse of their services or to meet legal obligations.
  • Translation history: Saved translations remain on your device until you delete them, clear your history, or uninstall the Service.
  • Device and usage data: Retained for as long as necessary to provide the Service, ensure its security, and analyze performance, after which it is deleted or irreversibly anonymised.
  • Purchase and subscription data: Retained for as long as your subscription is active and afterwards for the period required by applicable tax and accounting laws.
  • Support communications: Retained until your request is fully resolved and for a reasonable administrative period thereafter.
  • Consent records: Retained for as long as your consent remains active and as required to demonstrate compliance after withdrawal.

11. Your Device, iCloud Backups and Deletion

Translation history is stored in the Service’s protected storage on your device. If iCloud Backup is enabled, this history may be included in your backup. We have no access to data stored only on your device, and we cannot retrieve, restore or delete it on your behalf.

12. Other People’s Voices and Sensitive Content

Conversation features may capture the voices of people you speak with. Their speech is processed exactly as yours is, only to deliver the translation you requested, and they are never identified. Content you translate may reveal sensitive information; it is processed solely to translate it and never used for any other purpose.

13. Security

We protect Personal Data with technical and organisational measures, including encryption of all data in transit using TLS 1.2 or higher and storage of translation history in iOS protected app storage.

14. Children’s Privacy

The Service is not directed to children. We do not knowingly collect Personal Data from children under 13, or below the age of digital consent in their country of residence (14 in Cyprus and between 13 and 16 elsewhere in the EU). If we learn that we have collected such data, we will delete it. Parents can contact us at a.avirise@gmail.com.

15. Your Rights

Subject to applicable law, you have the right to access, rectify, erase, restrict, and receive your Personal Data, as well as object to processing and withdraw consent. To exercise your rights, contact us at a.avirise@gmail.com.

16. Additional Information for United States Residents

We do not collect biometric identifiers or biometric information, including voiceprints. We do not sell personal information for money. Residents of states with comprehensive privacy laws may exercise their rights of access, deletion, correction and opt-out by contacting us at a.avirise@gmail.com.

17. Links to Other Sites

The Service may contain links to third-party websites. We have no control over their data practices.

18. Changes to This Privacy Policy

We will notify you in the Service before any material change takes effect. Where the law requires, we will ask for your consent again.
